Welcome to Nerve Logistics. These Terms & Conditions ("Terms") govern your use of the NERVE Web App and the logistics services we provide. By creating an account, booking a trip, or using our services, you agree to be bound by these Terms.
Definitions
- NERVE refers to Nerve Logistics Limited.
- Web App refers to the NERVE web application and related services.
- Client refers to any individual or organization using NERVE's services.
- Trip refers to a transportation request created through the Web App.
- Contract Client refers to a client operating under a signed logistics agreement with NERVE.
- Non-Contract Client refers to a client using NERVE on a trip-by-trip basis.
Scope of Services
NERVE is a technology-enabled logistics company providing trucking services for the transportation of cargo through a network of trucking partners and operational personnel.
Our services currently support:
- Containerized Cargo
Support for Break-bulk Cargo and Heavy Equipment & Machinery will be introduced in future platform updates.
Account Registration
Clients are responsible for providing accurate registration information.
You are responsible for maintaining the security of your account and all activities carried out using your login credentials.
NERVE reserves the right to suspend or terminate accounts that contain false information or are used fraudulently.
Trip Booking
To create a trip, clients must provide accurate:
- Pickup location
- Destination
- Cargo type
- Cargo weight
- Cargo description
- Any required handling information
Trip estimates are generated using the information supplied by the client.
Providing inaccurate information may result in revised pricing, delayed dispatch, cancellation, or refusal of carriage.
Cargo Declaration & Customer Responsibilities
By booking a trip, you declare that:
- All cargo information provided is accurate and complete.
- The cargo is lawful to transport.
- Any special handling requirements have been disclosed.
- The cargo is properly packaged for transportation.
NERVE reserves the right to inspect cargo before or during loading.
Where the declared cargo materially differs from the actual cargo, NERVE may:
- Revise the trip price.
- Delay dispatch until corrections are made.
- Refuse transportation.
- Cancel the booking.
Clients are responsible for any additional costs arising from inaccurate cargo declarations.
Pricing
Trip pricing is generated based on factors including:
- Pickup location
- Destination
- Cargo type
- Cargo weight
- Truck required
Additional charges may apply where applicable, including:
- Demurrage
- Waiting charges
- Route-specific surcharges
- Other operational costs communicated to the client
Payments
Non-Contract Clients
Payment is required before a trip request is validated and dispatched.
Contract Clients
Payment terms are governed by the applicable Contract Client Agreement.
Cancellations
Trips may be cancelled at any time. Cancellation charges depend on how far the trip has progressed.
Early cancellations may attract only a small administrative charge.
Cancellations after truck dispatch, cargo pickup, or during transit may incur higher charges to recover operational costs already incurred.
Contract clients may have alternative cancellation terms under their agreements.
Demurrage
Demurrage applies where loading or unloading delays occur.
Demurrage is charged in 12-hour blocks. Each block attracts a fee of one-quarter (¼) to one-third (⅓) of the trip cost, depending on the applicable agreement.
Where cargo arrives outside normal working hours, the demurrage period begins from the next working hour.
Live Tracking
Once pickup has been confirmed, clients can monitor their cargo through the live tracking feature available within the Web App.
Tracking availability depends on the successful operation of GPS devices, mobile networks, and supporting technology. Temporary interruptions may occur.
Trip Supervision
Delivery Times
Estimated delivery times are provided to assist with planning. While NERVE strives to meet every estimated arrival time, delivery times are not guaranteed.
Delays may occur due to factors including:
- Traffic
- Weather
- Road conditions
- Mechanical failures
- Government inspections or checkpoints
- Civil unrest
- Other circumstances beyond NERVE's reasonable control
Where delays occur, NERVE will work to resolve operational issues and keep clients informed.
Cargo Insurance
NERVE is currently working with insurance providers to introduce Goods-in-Transit (GIT) insurance.
At present, cargo transported through NERVE is not covered by Goods-in-Transit insurance unless expressly agreed in writing.
Clients who require cargo insurance should arrange independent cover before transportation.
Prohibited Cargo
Clients must not book trips involving cargo that is illegal or prohibited under applicable law.
NERVE reserves the right to refuse transportation of any cargo that poses safety, legal, or operational risks.
Completed Trips
Upon successful delivery:
- The trip is marked as completed.
- Trip records remain available within the client's account.
- Contract client invoices are generated according to the applicable agreement.
Limitation of Liability
NERVE shall not be liable for losses or delays resulting from:
- Force majeure events
- Government actions
- Road closures
- Natural disasters
- Incorrect information supplied by the client
- Delays caused by loading or unloading parties
- Events beyond NERVE's reasonable control
Nothing in these Terms excludes liability where such exclusion is prohibited by applicable law.
